Note publique d'information : Introduction : La problématique de la distance chez le professionnel de santé dans
la relation médecin-patient amène à des manquements responsables de conflits voire
de plaintes. Nous avons voulu vérifier l'hypothèse qu'une mauvaise gestion voire des
manquements dans la distance médecin-patient de la part du praticien peut favoriser
la survenue de plaintes de patients. Nous avons fixé deux objectifs : retrouver un
certain nombre de plaintes favorisé par des manquements et identifier des facteurs
favorisant la mauvaise distance thérapeutique. Matériel et Méthode : Il s'agit d'une
étude quantitative de cas basés sur différentes sources : ordinale, assurantielle,
civile/pénale. La sélection des cas respecte des critères d'inclusion suivant le modèle
de la « pente glissante » et d'exclusion spécifique. Résultats : 17 cas de plainte
répondant aux critères ont été sélectionnés. Les cas recueillis furent l'objet d'une
analyse. Cette étude a permis d'identifier certains facteurs favorisants: modification
de la pratique médicale, les difficultés à la communication notamment professionnelle
ou à la gestion de la relation médicale, connotation commerciale de la pratique, méconnaissance
des codes civil et déontologique et leur conséquence, les difficultés personnelles
et/ou psychologiques du praticien, les dérives machistes, les sollicitations excessives
par surexposition aux tâches administratives, le suivi médical de proches, l'expérience/âge
du praticien, le milieu d'exercice, le genre, les spécialités médicales. Discussion
: Ce travail se base sur un nombre de cas limité et certains biais sont montrés ;
cela n'en affecte pas, pour autant, la pertinence de la discussion. Conclusion : Cette
recherche corrobore l'idée qu'un certain nombre de plaintes est favorisé par des manquements
à la bonne distance thérapeutique. La prévention à ces pratiques inadaptées passe
par une meilleure formation à la relation médecin-patient et à la communication professionnelle.
Note publique d'information : Introduction: The issues related to the notion of distance in the patient-physician
relationship lead to misconducts responsible of conflicts and complaints. This piece
of work wants to verify the hypothesis that a certain proportion of patients' complaints
is due to inappropriate practices of the physician within the frame of the patient-physician
relationship. Two main goals are targeted: 1) to find the complaints that are indeed
favored by these misconducts; 2) to identity the factors leading to the wrong-doing
in the patient-physician relationship.Resources & Method: This work is based on a
quantitative study of cases coming from ordinal, insurance-related, civil and penal
sources. The cases' selection is obeying criteria of inclusion according to the “slippery
slope” modeling and criteria of specific exclusion.Results: Seventeen cases in accordance
with the criteria have been selected and analyzed. This study has identified several
key factors leading to misconducts: deviation of the medical practice, communication
(mainly within the professional scope) during the medical practice, commercial connotation
of the practice, misreading or ignorance of the civil and/or deontological codes (and
their consequence), personal and/or mental difficulties of the physician, chauvinist
deviations, excessive exposition to administrative tasks leading to over-solicitations,
medical assistance/service to close relations, experience/age of the physician, working
environment, gender, medical specialty.Discussion: This work is based on a limited
number of cases and biases are considered. It is shown that it does not affect the
relevance of the study.Conclusion: The thesis confirms the idea that some complaints
are due to misconducts of the physician in the good patient-physician distance. To
prevent these “slippery behaviors” is to work on a better training in the field of
professional communication and of the patient-physician relationship.
