Note publique d'information : La liberté syndicale, le droit de grève et le principe de participation, inscrits
dans les alinéas 6,7 et 8 du Préambule de la Constitution de 1946, n'ont pas jusqu'à
présent véritablement retenu l'attention de la doctrine française. Le développement
simultané en France d'une réflexion d'envergure sur la théorie générale des droits
fondamentaux et du nombre de décisions rendues par le Conseil constitutionnel, a incité
l'auteur à proposer un renouvellement de l'analyse de ces trois libertés d'exercice
collectif. Contre l'opinion de la doctrine dominante, cette thèse montre que ces droits
sont de véritables droits constitutionnels, bénéficiant d'une protection constitutionnelle
effective, et susceptibles d'être directement appliqués par les juges ordinaires.
Par ailleurs, elle démontre l'intérêt que l'élévation, puis la protection de leurs
droits au rang constitutionnel revêtent pour les travailleurs
Note publique d'information : Union right, right of strike and participation principle, inscribed in the paragraphs
6,7 and 8 of the 1946 constitution preamble, have not been accorded the attention
of the French doctrine. The simultaneous developpement in France of a broad thought
about the general theory of the basic rights, and the amount of decisions pronounced
by the French constitutional court, has incited the author to propose a renewal of
the analysis of these three collective rights. Counter to the prevailing doctrine,
the doctoral thesis shows how these rights benefiting by a real constitutional protection,
and liable to be directly implemented by the ordinaires judges. Moreover, it shows
the importance of the upraising of the rights to the constitutional rank for the workers
