Note publique d'information : Analyse, dans une perspective évolutive, de l'application des règles du droit international
de la mer par l'Iran, en temps de paix, en temps de conflit armé. L'importance économique
et stratégique unique au monde du Golfe persique et par la même l'intervention extérieure,
ont fait de cette région une aire de tension ou déroule, en partie, l'organisation
du nouvel ordre mondial. Mer fermée, le Golfe persique soulève, en ce qui concerne
la gestion des ressources la navigation internationale et la préservation du milieu
marin, une série de problème justifiant la reconnaissance d'un statut particulier,
élaboré à l'échelon régional. Dans ce contexte, la délimitation des zones de juridiction
doit se faire dans un esprit de justice et d'équité selon le principe d'équidistance.
La question de l'accès au Golfe persique devrait être réglée par une convention régionale
dotant le Détroit d'Hormuz d'un régime spécial. L'analyse de la légalité des comportements
des états belligérants et non-belligérants dans la guerre du Golfe persique, confirment
la désuétude des règles traditionnelles du droit de la guerre maritime. Il semble
que de nouvelles règles coutumières sont nées de la pratique relative à cette guerre,
surtout en matière du droit de la neutralité.
Note publique d'information : This thesis intends to develop, through an evolutionary perspective, the application
by Iran of the rules of the international law of the sea in time of peace and of armed
conflicts. The unique economic and strategic situation of the Persian gulf in the
world and foreign interventions has made this region a center of tension, where the
new world organization will partially come true after the disintegration of the warsaw
pact. As a semi-enclosed sea, the Persian gulf raises a series of problems related
to the management of the resources, the international navigation and the preservation
of the marine environment, which jusitfy the recognition of a special status elaborated
at the regional level. In this context, the delimitation of the respective jurisdiction
zones should be accomplished in a spirit of justice and equity, according to the principle
of equidistance. The problem of access to the persian gulf should be solved by a regional
convention which should adopt a special status for the Strait of Hormuz. The analysis
of the legality of the belligerent and non belligerent states'behaviours in the war
of the gulf confirms the desuetudes of the traditional rules of the law of naval warfare.
It seems that new customary rules have come about, as a result of practices followed
in this war, particularly in the matter of the law of neutrality.
