légitime les atteintes portées à l’environnement. Dès lors, l’avènement des préoccupations
environnementales semble susciter l’apparition d’un conflit d’intérêt et de valeur
difficilement surmontable. Une démarche analytique de la théorie de l’abus de droit,
des mesures de droit public et la contractualisation environnementale a permis de
montrer les limites des dispositifs juridiques de droit public et privé. L’étude des
servitudes conventionnelles, de l’usufruit et des baux ruraux révèle une utilisation
environnementale limitée par de régimes juridiques mal adaptés. En définitive, la
protection globale de l’environnement ne peut être raisonnablement envisagée sans
la propriété foncière. La thèse se propose donc de redéfinir ou repenser le droit
de propriété à partir des concepts de développement durable, de patrimoine commun
de l’humanité ou l’idée de gestion patrimoniale de l’environnement.

the attacks carried to the environment. Consequently, the advent of environmental
concerns seems to give rise to the appearance of a conflict of interest and value
not easily surmountable. An analytical the of the theory of the abuse of rights, measurements
of public law and the environmental contractualisation have underlined the limits
of the legal devices of private and public law. The study of the conventional constraints,
usufruct and rural leases reveals that environmental use is limited by inadequate
legal regulation. Ultimately, the global protection of the environment cannot be reasonably
considered without land ownership. The thesis thus proposes to redefine or reconsider
the property rights starting from the concepts of durable development, common inheritance
of the humanity or the idea of patrimonial management of the environment.
