Note publique d'information : L'inarbitrabilité objective des litiges suppose l'exclusion de certaines matières
du domaine de l'arbitrage. Conformément à sa propre politique économique et sociale,
chaque Etat peut considérer que certaines questions sont susceptibles ou non d'être
réglées par voie d'arbitrage selon ses critères d'arbitrabilité objective et la loi
applicable à celle.ci. Mais, la question suscite de nombreuses difficultés liées à
la détermination de l'inarbitrabilité objective, la loi applicable à celle-ci et la
sanction encourue lors de sa constatation. Afin de surmonter ces difficultés, il faut
cerner les critères utiles déterminant l'inarbitrabilité objective. Cette détermination
nous permet de préciser la sanction encourue de la sentence arbitrale issue d'un litige
dont la matière est objectivement inarbitrable, soit au stade de la reconnaissance
et de l'exécution de la sentence. soit au stade des voies de recours susceptibles
d'être exercées à son encontre.
Note publique d'information : The objective inarbitrability of disputes assumes the exclusion of certains matters
in the field of the arbitration. ln accordance with its own economic and social policy,
each state can decide what questions are or not to be settled by way of arbitration,
according to its criteria of objective arbitrability and the law applicable to such
questions. However, many difficulties are associated with the determination of the
objective inarbitrability, the law applicable to it, as well as the sanction incurred
at the time of its observation. ln order to overcome these difficulties, it is necessary
to specify the criteria useful in determining the objective inarbitrability. This
specification enables us to determine the incurred sanction of the award arising from
a dispute which matter is objectively inarbitrable. This sanction applies either to
the recognition and the execution of the award, or at the stage when the ways of appeal
could be exercised.
