L’arbitrage présente une nature hybride, conventionnelle par sa source, juridictionnelle par son issue, qui est sans conteste la marque de son succès. Pourtant, l’identification des parties à l’arbitrage pose à l’heure actuelle de nombreuses difficultés. Si, normalement, seules les parties signataires de la convention d’arbitrage sont engagées à l’arbitrage, il est des cas où un litigant devient partie à l’arbitrage sans l’avoir voulu. À cet égard, on assiste aujourd’hui à un phénomène d’attraction de l’arbitrage sur des personnes n’ayant pas décidé de s’en remettre à des arbitres pour le règlement de leurs litiges. À l’inverse, il est d’autres cas où une partie signataire n’est plus engagée par le contrat parce que, par exemple, celui-ci a été cédé et se retrouve donc tiers à l’arbitrage, et la jurisprudence continue pourtant d’exclure des personnes ayant un intérêt à faire arbitrer leur différend au motif qu’elles sont étrangères à la convention d’arbitrage. En d’autres termes, la partie à la convention d’arbitrage, et la partie au procès arbitral ne sont pas nécessairement les mêmes. L’étude entreprise a pour ambition de redessiner les contours de la notion de partie afin de déterminer avec précision qui est, ou n’est pas, engagé par l’arbitrage. Il s’agira de partir des fondations de la notion de partie pour comprendre comment, lorsqu’elle est appliquée à l’arbitrage, elle s’en écarte afin de la colorer d’une certaine originalité. En d’autres termes, l’étude a pour objectif de proposer une notion raisonnée de la notion de partie dans l’arbitrage.
Arbitration has a hybrid nature, conventional in its source and jurisdictional in its issue, which is unquestionably the mark of its success. However, the identification of parties in arbitration raises many problems. If, normally, only the signatories to the arbitration agreement have agreed to arbitration, there are cases where a litigant becomes a party to the arbitration process without agreeing. In this regard, we observe today a phenomenon of attraction to arbitration for persons who previously have not decided to rely on arbitrators to settle their disputes. On the contrary, there are other cases where a signatory is not bound by the contract because, for example, it has been assigned and, thus, has become a third party in arbitration. Jurisprudence, however, continues to exclude persons who have an interest to arbitrate their dispute because they are third party to the arbitration agreement. Therefore, the party to the arbitration agreement and the party to the arbitration proceedings are not necessarily the same. The study aims to redraw the edges of the concept of party in order to accurately determine who is or isn’t bound by arbitration. We will study the origin of the concept of party to understand how, when applied to arbitration, it deviates to assign it originality. In conclusion, the study aims to propose a rational notion of the concept of party in arbitration.
