Note publique d'information : La tentative d'"ouverture" de la dictature franquiste et de la dictature des colonels
grecs a échoué à cause de sa contradiction fondamentale qui réside dans le fait que
sous la couverture d'une rhétorique démocratique les mécanismes juridiques adoptés
relevaient d'une conception autoritaire. La sortie de la dictature s'est faite à partir
d'une initiative prise aux plus hauts échelons du pouvoir autoritaire. Ce phénomène
d'��auto-rupture» se trouva à l'origine d'une apparence de légalité qui, selon des
modalités et des degrés différents, marqua certaines phases juridiques du processus
transitoire en Grèce et la totalité du processus en Espagne
Note publique d'information : In the early seventies, the Greek and the Spanish dictatorships tried to institutionalize
a "limited pluralism". The failure of this project and the breakdown of the two authoritarian
regimes must be attributed to the following contradiction : under a pseudo-democratic
rhetoric, the two dictatorships tried to apply authoritarian legal principles. The
transition to democracy started from a decision adopted by the most high placed authorities
of the dictatorship. This fact was the essential cause of an "appearance of legality"
phenomenon which caracterized certain legal phases of the transitional process in
Greece and the hole process in Spain
