Note publique d'information : Le principe de la « Communauté de droit »/« d’Union de droit » consacré par la Cour
de justice de l'Union européenne implique l'existence d'une protection juridictionnelle
effective de l'individu ; c'est la raison pour laquelle le droit de l'Union a érigé
en principe fondamental le « droit au juge », c'est-à-dire pour l'essentiel, le droit
des justiciables d'accéder à un tribunal. Ce droit garantit à l'individu un accès
concret à la juridiction. L'étude du droit à une protection juridictionnelle effective
en droit de l'Union européenne met en évidence la spécificité de l'accès à la juridiction
en droit de l'Union puisque, en sus de l'accès au juge de l'Union, l'individu a accès
au juge national pour la défense des droits qu'il tire du droit de l'Union. Par ailleurs,
l'étude du droit à une protection juridictionnelle effective ne se limite pas à la
seule problématique de l'accessibilité de la juridiction. Elle englobe également des
questions telles que la protection provisoire, l'égalité des justiciables quant à
l'accès au tribunal, ou encore, l'exécution des décisions de justice.
Note publique d'information : The principle of “Community of right”/”Union of right” established by the Court of
justice of the European Union involves the existence of an effective judicial protection
of the individual. That’s why the European law protects the “right to a judge” as
a fundamental right, meaning essentially, the right for citizen subject to the European
law to access a tribunal. This right guarantees to the individual a concrete access
to the jurisdiction. The study of “the right to an effective judicial protection”
brings to the fore the specificity of the access to the courts under European jurisdiction
because, in addition to access the European Court of justice, the individual have
the right of recourse to a national court to defend his rights inherited from the
European law. Moreover, this study is not only limited to the issue of the accessibility
of the jurisdiction but it also includes issues such as temporary judicial protection,
the equality of citizens in access to the courts, the enforcement of court judgments.
